Patna High Court

Ajit Ram @ Anjit RamversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted anticipatory bail to the petitioner subject to the stipulated conditions.

Summary

The petitioner, Ajit Ram, applied for anticipatory bail in connection with a kidnapping case (Turki P.S. Case No.70 of 2025) under sections 137(2), 96 and 3(5) of the Bihar Narcotic Substances Act, 2023. The victim, a 17‑year‑old girl, recorded a statement under section 183 of the same Act stating she left home, went to Delhi, met the petitioner and married him. The State opposed the bail. The court, after considering the victim’s statement, allowed the anticipatory bail, directing the petitioner to surrender within six weeks and furnish a bail bond of Rs.10,000 with two sureties, subject to conditions under section 438(2) of the CrPC and section 482 of the BNSS. The court clarified that its order is limited to the bail application and does not prejudice the merits of the trial.

Issues considered

  • Whether anticipatory bail can be granted in a kidnapping case under sections 137(2), 96 and 3(5) of the Bihar Narcotic Substances Act, 2023.
  • Whether the victim’s statement under section 183 of the BNSS impacts the grant of anticipatory bail.
  • Whether the conditions prescribed under section 438(2) of the CrPC and section 482 of the BNSS are satisfied.
