Patna High Court

Jagdish PaswanversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted anticipatory bail to the petitioner subject to the stipulated conditions.

Summary

Jagdish Paswan applied for anticipatory bail in a case where 654 litres of illicit liquor were seized near his residence and he was named in a prosecution under section 30(a) of the Bihar Prohibition and Excise Act. Paswan contended that he was falsely implicated, had no possession of the liquor and possessed a clean antecedent, and offered to donate Rs.25,000 to a charitable institution. The State opposed the bail. The High Court, after considering the facts and the petitioner's submissions, granted anticipatory bail subject to a bail bond of Rs.10,000 with two sureties, a mandatory donation of Rs.25,000 to the Ramakrishna Mission, verification of the receipt and clean antecedent, and regular attendance at the police station on specified days. The order was made under Section 438(2) of the CrPC and Section 482 of the BNSS, with a clarification that it does not prejudice the trial.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under Section 438 CrPC in a case under the Bihar Prohibition and Excise Act.
  • Whether the conditions imposed, including a charitable donation, sureties, and periodic police attendance, are permissible.
  • Whether the petitioner's claim of false implication and clean antecedent affect the grant of bail.
