Patna High Court

Dileep Kumar @ Dilip Kumar @ Dilip YadavversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court allowed the application for anticipatory bail, granting it with specified conditions.

Summary

The petitioners, Dileep Kumar and Ranvir Kumar, were implicated in a police case (Matihani P.S. Case No. 42 of 2026) for alleged possession of 2.960 litres of illicit liquor under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022. They applied for anticipatory bail, asserting innocence and clean antecedents, while the State opposed the relief. The court noted the small quantity involved and that the accused were not apprehended at the scene. Considering these factors, the court granted anticipatory bail subject to a bond of Rs.10,000 with two sureties and conditions of regular police station attendance and verification of antecedents. The order was made clear to be prima facie and not to affect the merits of the trial.

Issues considered

  • Whether anticipatory bail should be granted to the accused under the circumstances of the case
  • Whether the conditions imposed under Section 482(2) of the B.N.S.S. are appropriate

2 17-06-2026 Heard learned counsel for the petitioners and

                   learned A.P.P. for the State.

                                   2. The petitioners apprehend arrest in connection

with Matihani P.S. Case No. 42 of 2026 registered for offences

under Section 30(a) of the Bihar Prohibition and Excise

                   (Amendment) Act, 2022.

the petitioners are innocent and have committed no offence.

Learned counsel submits that the names of the petitioners have

                          5. Learned A.P.P. for the State has vehemently

          opposed the prayer for bail.

                          6. Considering the small amount recovered and the

fact that the petitioners were not caught on the spot, this

application for anticipatory bail stands allowed.

                          7. Accordingly, let the petitioners, above-named, in

the event of arrest or surrender within four weeks from today in
