Patna High Court

Azmal Ansari @ Azmal HusainversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court held that anticipatory bail is warranted as the petitioner’s circumstances and the nature of the allegations do not preclude the grant of bail under Section 482(2).

Summary

The petitioner, Azmal Ansari, sought anticipatory bail in connection with a criminal case (PS No. 178 of 2025) alleging offences under several sections of the Bihar Negotiable Securities Act, 2023. The prosecution alleged that the petitioner caused simple injury to the informant, while the petitioner claimed innocence and a clean antecedent, asserting the incident arose from a minor dispute. The State opposed the bail application, arguing the seriousness of the charges. The Court examined the merits of the anticipatory bail petition, considering the provisions of Section 482(2) of the B.N.S., 2023 and the principles governing bail. Finding no compelling reason to deny bail and noting the petitioner’s clean record, the Court allowed the anticipatory bail with conditions. The order directed the petitioner to furnish a bail bond of Rs. 10,000 with two sureties and clarified that the observations were prima facie and not indicative of the case’s merits.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under Section 482(2) of the B.N.S., 2023.
  • Whether the nature of the alleged offences warrants denial of bail.
