Holding

The court granted permission to withdraw the anticipatory bail application, allowing the petitioner to surrender and seek regular bail without prejudice.

Summary

The petitioner, Satyam Saurabh, faced an anticipatory bail application in connection with a cyber‑crime case involving offences under the Bharatiya Nyaya Sanhita and the Information Technology Act. He feared arrest and sought permission to withdraw the anticipatory bail application, requesting liberty to surrender before the lower court and apply for regular bail. The court considered whether such withdrawal could be permitted without prejudice to any subsequent regular bail application. It held that the petitioner may withdraw the anticipatory bail application and be allowed to surrender, and that this withdrawal would not affect the consideration of any regular bail petition. Consequently, the anticipatory bail application was dismissed as withdrawn, with liberty granted to seek regular bail.
