Holding
The court granted regular bail to the petitioner.
Summary
Ranveer Kumar was arrested in connection with the seizure of 52 litres of illicit liquor from a bike, alleged to violate Sections 30(a), 41 and 44 of the Bihar Prohibition and Excise Act. The petitioner claimed he had no possession of the liquor, was falsely implicated, and that the police failed to comply with Section 105 of the B.N.S.S. during the seizure. He had been in judicial custody since 18 April 2026, while the State highlighted his four prior criminal cases, including one of a similar nature, to oppose bail. After hearing both sides, the court considered the lack of direct evidence against the petitioner and the procedural lapse, and decided to grant regular bail. He was released on a bail bond of Rs.10,000 with two sureties, subject to the satisfaction of the Exclusive Special Court, Excise‑2, Nawada.
Issues considered
- Whether the petitioner is entitled to regular bail despite the alleged seizure of illicit liquor and prior criminal antecedents.
- Whether the police’s non‑compliance with Section 105 of the B.N.S.S. during seizure affects the bail decision.
- Whether the absence of recovered liquor from the petitioner’s possession justifies bail.
