Patna High Court

Bablu Kumar @ Bablu Kumar SahversusThe state of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court held that bail should be granted to the petitioner subject to a bond and specified conditions.

Summary

The petitioner, Bablu Kumar, was arrested on 19 April 2026 in connection with the seizure of 59 litres of codeine‑containing cough syrup, alleged to be a violation of Section 30(a) of the Bihar Prohibition & Excise Act, 2016. He contends that he was falsely implicated, arguing that his name was added to the FIR only because the recovered motorcycle belonged to him and that no substantive evidence links him to the offence. The petitioner also highlighted that a co‑accused, Niraj Kumar Sah, had previously been granted bail in a similar case. The State opposed bail, noting that the petitioner has another pending case and is already on bail in that matter. After considering the circumstances, the Court ordered the petitioner’s release on bail upon furnishing a bond of Rs 10,000 with two sureties and imposed conditions regarding cooperation, non‑tampering of evidence, and verification of criminal antecedents. The bail order was made subject to the satisfaction of the Exclusive Special Judge, Excise‑II, Araria.

Issues considered

  • Whether bail should be granted to the petitioner under the provisions of the Criminal Procedure Code in a case involving alleged violation of Section 30(a) of the Bihar Prohibition & Excise Act, 2016.
  • Whether the petitioner’s alleged involvement, based solely on ownership of a recovered motorcycle, warrants continued detention.
  • Whether the petitioner’s prior criminal antecedents and pending cases affect the grant of bail.
