The court held that anticipatory bail may be granted in the present circumstances, subject to Section 482(2) of the Bharatiya Nyaya Sanhita, 2023.
Summary
The petitioner, Moti Singh, sought anticipatory bail fearing arrest in a case registered under Sections 126(2), 115(2), 109 and 3(5) of the Bharatiya Nyaya Sanhita, 2023 for alleged assault on an informant and the informant’s son. The prosecution alleged that the petitioner, along with others, attacked the informant with an iron rod and bricks, causing serious injury and unconsciousness. The petitioner contended he was innocent, asserting that the informant was his brother and that no specific allegation of assault against him existed. The court, after considering the relationship between the parties and the nature of the injury, allowed the anticipatory bail application, directing the petitioner to furnish a bail bond of Rs.10,000 with two sureties, subject to conditions under Section 482(2) of the BNSS. The order was made on a prima facie basis and does not prejudice the merits of the trial.
Issues considered
- Whether anticipatory bail should be granted in a case involving alleged assault under the Bharatiya Nyaya Sanhita, 2023.
- Whether the familial relationship between the petitioner and the informant and the nature of the alleged injury justify the grant of anticipatory bail.
