DISMISSED

Holding

Anticipatory bail was not granted and the application was dismissed.

Summary

The petitioner, Shabuddin Dewan, applied for anticipatory bail fearing arrest in a case registered under Sections 317(5) and 111 of the Bharatiya Nyaya Sanhita, 2023 and Sections 11, 11(D)(E)(F)(L) of the Prevention of Cruelty to Animal Act, alleging involvement in unloading stolen cattle, one of which was recovered from his van. The court examined the nature and gravity of the alleged offences, particularly the theft of livestock and animal cruelty. Considering the seriousness of the charges, the court declined to grant anticipatory bail. The application for anticipatory bail was dismissed, but the petitioner was permitted to surrender within two weeks and seek regular bail. The court clarified that its observations were limited to the anticipatory bail application and would not prejudice later proceedings.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner in view of the alleged offences under the Bharatiya Nyaya Sanhita and the Prevention of Cruelty to Animal Act
  • Whether the nature and gravity of the alleged cattle theft and animal cruelty offences justify denial of anticipatory bail
