Decided

DISMISSED

Holding

Anticipatory bail was denied to the petitioner.

Summary

Naval Yadav applied for anticipatory bail after being implicated in a case (Kashimbazar P.S. Case No. 80 of 2026) for alleged offences including assaulting police and facilitating the escape of a person arrested for illicit liquor. The prosecution alleged that Yadav and others freed the arrested individual and assaulted the police party. The court examined the seriousness of the allegations under multiple sections of the Bharatiya Nyaya Sanhita, 2023 and the Bihar Prohibition and Excise Act. Considering the nature of the offences, the court declined to grant anticipatory bail. The application was dismissed, but Yadav was permitted to surrender within two weeks and seek regular bail. The court clarified that its observations are limited to this application and do not prejudice future proceedings.
