Patna High Court

Parma Ray @ Parma RaiversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted bail to the petitioners, directing them to furnish the requisite bond and sureties.

Summary

Petitioners Parma Ray and Vishal Yadav applied for bail fearing arrest in Sonpur P.S. Case No. 94 of 2026, which alleged offences under several sections of the Bihar Negotiable and Securities Act (BNS) including assault and criminal intimidation. They claimed innocence, alleged false implication, and highlighted a counter‑case and lack of prior criminal record, asserting the FIR indicated a road‑rage incident. The learned counsel argued that the petitioners were unlikely to flee and that bail was appropriate. The Court examined the allegations and, noting the circumstances, allowed the bail application. The petitioners were directed to secure bail by furnishing a bond of Rs. 10,000 with two sureties, subject to conditions under Section 438(2) of the CrPC and Section 482 of the BNS.

Issues considered

  • Whether bail should be granted to the petitioners under Section 438(2) of the Code of Criminal Procedure, 1973 and Section 482 of the Bihar Negotiable and Securities Act.
  • Whether the petitioners pose a flight risk or threat to the investigation in the context of the alleged road‑rage incident.
