The Court granted anticipatory bail to the petitioner, subject to a bail bond, a charitable donation, and regular police‑station attendance.
Summary
Arun Singh (Petitioner) feared arrest in a case under Section 30(a) of the Bihar Prohibition and Excise Act for allegedly possessing about nine litres of illicit liquor. The prosecution’s case was based solely on a self‑incriminating statement of a co‑accused; the petitioner was not caught in the act and claimed innocence. He offered to donate Rs. 25,000 to a charitable institution without admitting guilt. The High Court, after hearing counsel, granted anticipatory bail, directing the petitioner to furnish a bail bond of Rs. 10,000 with two sureties and to deposit the Rs. 25,000 with the Ramakrishna Mission Ashram, producing a receipt. Additional conditions included weekly attendance at the police station and compliance with Section 438(2) of the CrPC and Section 482 of the BNSS. The order was made subject to verification of the donation receipt and the possibility of cancellation on default.
Issues considered
- Whether anticipatory bail should be granted to the petitioner under Section 438 of the Code of Criminal Procedure, 1973 and Section 482 of the BNSS in a case under Section 30(a) of the Bihar Prohibition and Excise Act.
- Whether imposing a condition of a charitable donation as part of bail is permissible.
