Holding
The court granted anticipatory bail to the petitioner, subject to specified conditions.
Summary
Shivam Kumar was implicated in a case involving the seizure of 3,584.60 litres of Indian-made foreign liquor from a truck, alleged under IPC sections 272, 273, 420 and 120B and Bihar Prohibition and Excise Act sections 30(a) and 41(1). The petitioner claimed a clean antecedent and argued that the liquor was not found in his conscious possession, with the only link being the co-accused’s disclosure of his name. The State opposed anticipatory bail, invoking Section 76(2) of the Bihar Prohibition and Excise Act and contending that pre‑arrest bail was not permissible. Relying on the Full Bench decision in Ram Vinay Yadav v. State of Bihar and noting the lack of material directly implicating the petitioner, the court granted anticipatory bail subject to a bond of Rs 10,000, two sureties, and conditions under Section 438(2) CrPC and Section 482(2) BNSS, 2023. The order also imposed compliance requirements such as cooperation with the trial and non‑tampering with evidence.
Issues considered
- Whether anticipatory bail can be granted to the petitioner despite the serious offences alleged under the IPC and Bihar Prohibition and Excise Act.
- Whether the procedural requirements under Section 100 CrPC/Section 103 BNSS, 2023 for seizure were complied with, affecting bail eligibility.
- Whether Section 76(2) of the Bihar Prohibition and Excise Act bars the grant of pre‑arrest bail in this circumstance.
