Patna High Court

Chunchun Prasad JaiswalversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Anticipatory bail is granted to the petitioner subject to stringent conditions.

Summary

The petitioner, Chunchun Prasad Jaiswal, sought anticipatory bail fearing arrest in Excise Case No. 865 of 2025 under sections 30(a) and 32 of the Bihar Prohibition and Excise Act for alleged possession of 3.375 litres of foreign liquor seized from a two-wheeler. The prosecution alleged that the motorcycle, owned by the petitioner, was used by his employee Ujjwal Sahni, leading to the FIR and the arrest of two others. The petitioner argued he had no criminal antecedent and that mere ownership of the vehicle should not attract liability, relying on the Full Bench judgment in Ram Vinay Yadav v. State of Bihar which permits anticipatory bail despite the bar in Section 76(2) if no offence is made out. The State opposed, asserting ownership of the motorcycle. The Court, after considering the precedent and the petitioner’s clean record, granted anticipatory bail with a bond of Rs. 10,000 and multiple conditions regarding appearance, cooperation, and non‑interference with witnesses.

Issues considered

  • Whether anticipatory bail can be granted in a case under the Bihar Prohibition and Excise Act despite the bar under Section 76(2).
  • Whether mere ownership of a vehicle used by an employee constitutes sufficient basis for arrest under sections 30(a) and 32.
  • Whether the petitioner’s lack of prior criminal antecedent warrants the grant of anticipatory bail.

                                       ORAL ORDER

2 17-06-2026 Heard Ms. Harsha Shashwat, learned counsel for

the petitioner and learned APP representing the State.

                                  2. The petitioner is apprehending his arrest in

connection with Excise P.S. Case No. 865 of 2025 for the

offence under sections 30(a) and 32 of the Bihar Prohibition and

Excise Act lodged on 27.12.2025 by the informant, Ajay Kumar.

                                  3. As per the prosecution story, the informant alleged

that the Police on secret information intercepted a two wheeler

and there is recovery/seizure of 3.375 liters foreign liquor. On

Ujjwal Sahni alongwith Shailendra Kumar were arrested. This

                   led to the FIR.

                                  4. Learned counsel for the petitioner submits that he

do not have criminal antecedent and only because motorcycle

was handed over to Ujjwal Sahni, his employee, got implicated.

                       5. Further, learned counsel for the petitioner relied on

the judgment of the Full Bench of Hon’ble Patna High Court in

the case of Ram Vinay Yadav vs. State of Bihar reported in

2019 (2) PLJR 1089 wherein it has been held that an

application for anticipatory bail in a case arising out of Bihar

Excise and Prohibition Act can be maintained, despite the bar

under Section 76(2) of the Act, if on the basis of allegation

made in the FIR, no offence under the said provision is made

          out.

                       6. Learned APP opposes the prayer submitting that he

          owns the motorcycle.

                       7. Taking into account the submissions of the parties

and the judgment in the case of Ram Vinay Yadav (supra), as

also that Ujjwal Sahni and Shailendra Kumar stand arrested

with the liquor, he do not have criminal antecedent, in that

background, this Court is inclined to extend him the privilege of

          anticipatory bail with conditions.

                       8. Let the petitioner be released on bail in the event of

arrest or surrender within a period of four weeks from the

receipt of this order, on furnishing bail bond of Rs. 10,000/-
