The High Court granted anticipatory bail to the petitioner subject to prescribed conditions.
Summary
The petitioner, Raj Kumar Das, sought anticipatory bail fearing arrest in a FIR (Bibhutipur PS Case No.174 of 2024) that alleged his involvement in a violent incident resulting in the death of a husband, with offences under several IPC sections. The petitioner argued he has a clean antecedent and that the FIR contains only a generic allegation against all accused, with no specific act attributed to him. The prosecution opposed bail. The Court noted the petitioner’s clean record, the lack of specific allegation, the existence of a case‑and‑counter‑case, and that several co‑accused had already been granted anticipatory bail. Accordingly, the Court granted anticipatory bail on a bond of Rs 10,000 with two sureties, subject to conditions under Section 438(2) CrPC and Section 482(2) BNSS, 2023, including cooperation with the trial and non‑tampering with evidence. The bail order directs the lower court to release the petitioner if arrested within thirty days, pending verification of antecedents.
Issues considered
- Whether the petitioner is entitled to anticipatory bail despite the serious nature of the offences alleged in the FIR
- Whether the lack of a specific allegation against the petitioner and his clean antecedent justify granting bail
