Patna High Court

Vijay YadavversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court held that anticipatory bail is to be granted to the petitioner, subject to the conditions imposed.

Summary

The petitioner, Vijay Yadav, sought anticipatory bail fearing arrest in a case (Khiri More PS Case No. 132 of 2025) involving offences under Sections 281, 125(a), 109, 132 and 3(5) of the Bharatiya Nyaya Sanhita, 2023 for rash and negligent driving that injured police personnel. The FIR named only the vehicle (a Scorpio, Reg. No. UP 16AP 2954) and not the driver; during investigation the vehicle owner alleged that the petitioner was the driver, which the petitioner denied, claiming false implication and asserting a clean antecedent. The State opposed the bail. The High Court, after considering the facts and submissions, granted anticipatory bail under Section 438(2) of the Code of Criminal Procedure read with Section 482(2) of the Bharatiya Nyaya Sanhita, subject to specific conditions including surety, personal presence in court, and verification of antecedents. The order clarified that any observations made would not affect the trial. The bail was to be effective for four weeks from the order date.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under Section 438 CrPC in view of the allegations of rash driving and his claim of false implication.
