Patna High Court

Lal Mohan RamversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted bail to the petitioner subject to a bond and specified conditions.

Summary

Lal Mohan Ram was arrested on 1 May 2026 in connection with the seizure of 12.8 litres of foreign liquor alleged to violate Section 30(a) of the Bihar Prohibition and Excise Act, 2018. The petitioner claimed he was falsely implicated, arguing that the liquor was recovered from a corn field behind his house and not from his conscious possession, and that the seizure was conducted by Home Guard personnel without complying with Sections 103 and 105 of the BNSS. The prosecution opposed bail, citing four prior criminal antecedents of a similar nature, though noting the petitioner was already on bail for those cases. The court considered the lack of direct possession, the procedural objections, and the antecedents, and decided to grant bail on a bond of Rs.10,000 with two sureties, subject to conditions of cooperation, appearance, non‑tampering with evidence, and verification of antecedents. The bail order was made without delay for verification of the antecedents.

Issues considered

  • Whether bail should be granted to the accused under Section 30(a) of the Bihar Prohibition and Excise Act, 2018 given the alleged lack of possession and procedural lapses.
  • Whether the prior criminal antecedents of the accused warrant denial of bail.
