BAIL GRANTED

Holding

The Court granted anticipatory bail to the petitioners, subject to conditions, as there were no specific allegations against them and they possessed clean antecedents.

Summary

The petitioners Raja Kumar, Golu Kumar and Aditya Kumar sought anticipatory bail fearing arrest in connection with FIR No. 312 of 2025 alleging offences under various sections of the Bihar Naxal Suppression Act, 2023. They contended that they have clean antecedents, were falsely implicated, and that the FIR contains only a generic allegation without specific acts attributed to them. The prosecution opposed the bail, arguing the seriousness of the offences. The Court noted that similarly situated co‑accused had been granted anticipatory bail in earlier proceedings. Considering the lack of specific allegations against the petitioners, their clean record, and the precedent of bail to co‑accused, the Court granted anticipatory bail subject to a Rs.10,000 bond, two sureties and several conditions under Section 438(2) of the CrPC. The order directed the lower court to release the petitioners on bail if they surrender within thirty days and to enforce the stipulated conditions.

Issues considered

  • Whether anticipatory bail should be granted to the petitioners despite the serious nature of the offences alleged in the FIR.
  • Whether the absence of specific allegations against the petitioners warrants the grant of bail.
  • Whether the grant of anticipatory bail to similarly situated co‑accused influences the decision.

Shailendra Kumar, learned Additional Public Prosecutor for the

State in Cr. Misc. No. 38906 of 2026.

                      2. The petitioners are apprehending their arrest in

connection with Beldaur P.S. Case No. 312 of 2025, F.I.R. dated

20.10.2025 for the offences punishable under Sections 191(1),

          351(2&3) of the BNS, 2023.

                      3. According to prosecution case, 51 named and 100-

          police personnel.

                      4. Learned counsel for the petitioners submits that

petitioners have clean antecedent and they have falsely been

implicated in the present case. He further submits that the

allegation as alleged in the F.I.R is false and fabricated and the

petitioners have not committed any offence as alleged in the

F.I.R. It appears from the F.I.R that there is no specific

allegation of assault or overt act attributed against the

petitioners rather there is general and omnibus allegation against

all the accused persons including these petitioners. In fact, the

FIR has been instituted against 51 named and 100-150 unnamed
