BAIL GRANTED

Holding

The Court granted bail to the petitioner subject to a bond and specified conditions.

Summary

Sunil Kumar Yadav was arrested on 29-04-2026 for alleged possession of 624.6 litres of foreign liquor seized from a vehicle, alleged to violate Section 30(a) of the Bihar Prohibition and Excise Act, 2018. He contended that the liquor was not in his conscious possession, that the seizure was conducted by police officers who failed to comply with procedural requirements under Sections 103 and 105 of the BNSS, and that he was falsely implicated. The prosecution opposed bail, citing two prior criminal antecedents, though noting that he was already out on bail for those matters. The High Court, after considering the arguments, granted bail on a bond of Rs.10,000 with two sureties and imposed conditions regarding court attendance, non‑tampering with evidence, and verification of his antecedents. The order directed that bail should not be delayed for verification purposes.

Issues considered

  • Whether bail should be granted to the accused under Section 30(a) of the Bihar Prohibition and Excise Act, 2018 considering alleged procedural lapses in seizure.
  • Whether the accused's prior criminal antecedents justify denial of bail.
