Patna High Court

MD. AKBAR @ AKBARversusTHE STATE OF BIHAR

Decided
Disposal
BAIL GRANTED

Holding

The court allowed the anticipatory bail application, granting bail to the petitioners subject to conditions.

Summary

The petitioners sought anticipatory bail in connection with a criminal case (Jokihat P.S. Case No. 32 of 2025) involving offences under several sections of the Bihar Negotiable Sale Act and the Indian Penal Code. The prosecution alleged that the petitioners, who are agnates of the informant, attempted to seize ancestral land, trespassed with weapons, threatened the informant, and used a forged khatiyan. The petitioners contended they were falsely implicated and claimed innocence, acknowledging a prior criminal antecedent. The informant and the State opposed the bail, arguing the seriousness of the offences and potential for tampering with evidence. The High Court, applying Section 438(2) of the Code of Criminal Procedure and Section 482 of the BNSS, allowed the anticipatory bail application, directing release on bail with a bond of Rs. 10,000 and two sureties, subject to standard conditions.

Issues considered

  • Whether anticipatory bail can be granted under Section 438 CrPC and Section 482 BNSS in view of the alleged offences and facts.
  • Whether the petitioners pose a risk of fleeing, tampering with evidence, or influencing witnesses.
  • Whether the land dispute and alleged forgery affect the grant of bail.
