BAIL GRANTED

Holding

The Court granted anticipatory bail to the petitioners subject to the conditions prescribed under Section 438(2) CrPC and Section 482 B.N.S.

Summary

The petitioners, four residents of Garhpura, sought anticipatory bail fearing arrest in a case (Garhpur P.S. Case No. 110 of 2025) alleging offences under several sections of the B.N.S., including assault. They claimed innocence, stating that the actual assailants had already obtained anticipatory bail, and highlighted their own prior criminal antecedents. The State opposed the bail, arguing the seriousness of the charges. The Court examined the merits, the prior antecedents, and the statutory provisions governing anticipatory bail. It allowed the petitioners’ application, directing that they be released on bail if arrested or surrendered within four weeks, subject to a bond of Rs. 10,000 with two sureties and conditions under Section 438(2) of the CrPC and Section 482 of the B.N.S.

Issues considered

  • Whether anticipatory bail can be granted to the petitioners under Section 438 of the CrPC despite the nature of the alleged offences.
  • Whether the petitioners' prior criminal antecedents preclude the grant of anticipatory bail.
  • Whether the prosecution’s case warrants denial of anticipatory bail under Section 482 of the B.N.S.
