Holding
The court held that anticipatory bail may be granted where the accused has no conscious possession of the contraband and a clean antecedent, notwithstanding the provisions of Section 76(2) of the Bihar Prohibition and Excise Act.
Summary
Mantu Kumar, the driver of a vehicle from which 1,950 litres of country-made mahua liquor was seized, was implicated in a case under Section 30(a) of the Bihar Prohibition and Excise Act. He applied for anticipatory bail, arguing that the liquor was not found in his conscious possession, he had a clean antecedent, and he was named only because he was the driver. The prosecution opposed the bail, invoking Section 76(2) of the Act which restricts pre‑arrest bail. Relying on the Full Bench decision in Ram Vinay Yadav v. State of Bihar and noting the lack of direct involvement, the court granted anticipatory bail with a bond of Rs.10,000 and two sureties, subject to conditions under Section 438(2) of the CrPC. The order also imposed compliance requirements such as cooperation with the trial, presence in court, and non‑tampering with evidence.
Issues considered
- Whether anticipatory bail can be granted to an accused driver when the seized liquor was not in his conscious possession.
- Whether Section 76(2) of the Bihar Prohibition and Excise Act bars the grant of anticipatory bail in such circumstances.
