Holding

Mere ownership of a vehicle from which illicit liquor is recovered does not amount to conscious physical possession, warranting the grant of bail.

Summary

The petitioner, Abhishek Kumar, was named in an FIR for alleged illegal manufacturing and trading of illicit liquor under Section 30(a) of the Bihar Prohibition and Excise Act and Section 414 of the IPC, with 32 litres of liquor recovered from a motorcycle he owned. He contended that he did not have conscious physical possession of the liquor, merely being the registered owner of the vehicle used to transport it, and highlighted his clean antecedents. The State opposed his bail application. The court observed that the recovery of liquor was not prima facie linked to the petitioner's conscious possession and, considering his clean record, found no justification to deny bail. Accordingly, the court directed his release on bail with a bond of Rs.10,000 and two sureties, subject to conditions under Section 438(2) of the Cr.P.C. and Section 482(2) of the BNSS.

Issues considered

  • Whether recovery of illicit liquor from a vehicle owned by the accused constitutes conscious physical possession for the purposes of Sections 30(a) Bihar Prohibition and Excise Act and 414 IPC.
  • Whether bail can be granted under Section 438(2) Cr.P.C. and Section 482(2) BNSS in the circumstances.
