Patna High Court

Rahul KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted bail to the petitioner subject to a bond and specified conditions.

Summary

Petitioner Rahul Kumar was arrested on 17 May 2026 in connection with a case involving the alleged contravention of Section 30(a) of the Bihar Prohibition & Excise Act, 2016, for the seizure of 55 litres of illicit liquor from a motorcycle. He contended that the liquor was not in his conscious possession and that the seizure was conducted by Bihar Home Guard personnel without complying with Sections 103 and 105 of the BNSS, 2023, rendering the charge baseless. The State opposed bail, noting two other similar pending cases, though the petitioner was already on bail in those matters. The Court, after considering the lack of direct possession and procedural lapses, granted bail on a bond of Rs.10,000 with two sureties, imposing conditions of cooperation, appearance, non‑tampering with evidence, and verification of criminal antecedents. The bail order was directed to be executed without delay for verification purposes.

Issues considered

  • Whether bail should be granted to the petitioner under Section 30(a) of the Bihar Prohibition & Excise Act, 2016.
  • Whether the alleged non‑compliance with Sections 103 and 105 of the BNSS, 2023, warrants denial of bail.
  • Whether the existence of other pending cases of a similar nature affects the grant of bail.
