Patna High Court

Ram Pravesh RaiversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted bail to the petitioner subject to specified conditions.

Summary

Ram Pravesh Rai, a driver, was arrested on 18 March 2026 in connection with a case involving the seizure of 405 litres of country‑made liquor from a motorcycle. He was charged under Section 30(a) of the Bihar Prohibition & Excise Act, 2016. The petitioner contended that the liquor was not found in his conscious possession and that the seizure violated Sections 103 and 105 of the Bihar Narcotic Substances (BNSS) Act, 2023, rendering the investigation defective. The State opposed bail, noting the petitioner’s involvement in four other cases, though he was already on bail in those matters. The High Court, considering the lack of conscious possession and procedural lapses, granted bail on a Rs 10,000 bond with two sureties and imposed conditions regarding trial cooperation, evidence tampering, and verification of criminal antecedents.

Issues considered

  • Whether bail should be granted when the seized contraband was not in the accused's conscious possession.
  • Whether non‑compliance with Sections 103 and 105 of the BNSS, 2023, warrants bail.
  • Whether the existence of other pending cases affects the grant of bail in the present matter.

other than the present one but fairly submits on the basis of

paragraph-3 of the bail petition that the petitioner is on bail in

          the pending matters.

                       6. Considering the facts and circumstances of the case

and the fact that nothing has been recovered from the conscious
