Patna High Court

Pancham Kumar Singh @ Panchan kumar singhversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court held that bail should be granted to the petitioner, subject to specified conditions.

Summary

Petitioner Pancham Kumar Singh was arrested on 2 April 2026 in connection with the seizure of 160 litres of country-made Mahua liquor from a motorcycle, alleged to violate Sections 274 and 275 of the Bihar Narcotic Substances Act and Section 30(a) of the Bihar Prohibition & Excise (Amendment) Act, 2022. He contended that he has a clean antecedent, is not the owner of the motorcycle, and that the seizure was conducted by Home Guard and police personnel without complying with Sections 103 and 105 of the BNSS, 2023. The State opposed bail. The Court examined the procedural lapses, the petitioner’s lack of ownership, and his clean record, and concluded that these factors warranted bail. Accordingly, the Court ordered his release on bail of Rs.10,000 with two sureties, subject to conditions of cooperation, presence in court, non‑tampering with evidence, and verification of antecedents. The bail bond is to be accepted without delay for verification purposes.

Issues considered

  • Whether bail should be granted to the accused despite alleged violations of Sections 274, 275 of the BNSS and Section 30(a) of the Bihar Prohibition & Excise (Amendment) Act, 2022.
  • Whether non‑compliance with Sections 103 and 105 of the Bihar Narcotic Substances Act, 2023, regarding seizure procedures, justifies bail.
  • Whether the petitioner’s clean antecedent and lack of ownership of the seized vehicle warrant bail.
