The court granted anticipatory bail to the petitioner, subject to conditions, notwithstanding the State’s objections.
Summary
The petitioner, Rahul Sah, was implicated in a case involving the seizure of 161.4 litres of country-made liquor under Section 30(a) of the Bihar Prohibition and Excise Act. No liquor was recovered from his possession; his alleged involvement rests solely on a statement by a co‑accused who had been apprehended. The petitioner sought anticipatory bail, arguing that the accusation was unfounded and that mandatory provisions of Sections 103 and 105 of the BNSS, 2023, were not complied with. The State opposed the bail, invoking Section 76(2) of the Bihar Prohibition and Excise Act and citing the petitioner’s prior criminal cases. Relying on the Full Bench decision in Ram Vinay Yadav v. State of Bihar, the court granted anticipatory bail with a bond of Rs 10,000, two sureties, and conditions under Section 438(2) of the CrPC, including cooperation with the trial and non‑tampering with evidence.
Issues considered
- Whether anticipatory bail can be granted when the only evidence against the petitioner is a co‑accused’s disclosure and no material has been seized from his possession.
- Whether Section 76(2) of the Bihar Prohibition and Excise Act bars the grant of anticipatory bail in such circumstances.
- Whether non‑compliance of Sections 103 and 105 of the BNSS, 2023, affects the petitioner’s right to anticipatory bail.
