Patna High Court

Nisha @ Nisha Devi @ Nisha Kumari @ M. NishaversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court held that, on a prima facie basis, there is no evidence linking the petitioner to the alleged monetary transactions and therefore granted bail.

Summary

The petitioner, Nisha Devi, was named in an FIR for alleged cheating involving the distribution of nude videos and monetary fraud amounting to Rs. 17 lakh, under Sections 303(2), 318(4) and 3(5) of the BNS. She contended that no bank transactions were made in her name and that she was implicated solely because she is the wife of a co‑accused. The informant’s counsel argued that the petitioner was actively involved in the offence. The court examined the bank statements and found no prima facie evidence linking the petitioner to the transactions, noting her clean antecedent. Consequently, the court ordered her release on bail with a bond of Rs. 10,000 and two sureties, subject to conditions under Section 482(2) of the BNSS.

Issues considered

  • Whether the FIR and the material on record establish a prima facie case against the petitioner sufficient to deny bail.
  • Whether the absence of any bank transaction in the petitioner’s name negates her alleged participation in the cheating offence.
  • Whether Section 482(2) of the BNSS can be invoked to grant bail in the present circumstances.
