Decided
Disposal
BAIL GRANTED

Holding

The Court allowed the petitioner's application for regular bail.

Summary

The petitioner, Deepak Kumar, was arrested in connection with a murder case (PS Case No. 78 of 2025) under Sections 115(2), 126(2), 80 and 85 of the Bharatiya Nyaya Sanhita, 2023. He contended that he is innocent, that the deceased was his wife who committed suicide, and that he has a clean antecedent, having been in custody since 9 January 2026. The State opposed his request for regular bail. After considering the facts, submissions of counsel, and the investigation material, the Court allowed the bail application. The petitioner was ordered to be released on a bail bond of Rs. 10,000 with two sureties of the same amount, with the order expressly limited to the bail matter and not on the merits of the trial.

Issues considered

  • Whether the petitioner is entitled to regular bail in a murder case under the Bharatiya Nyaya Sanhita, 2023, considering the allegations, custody period, and claim of suicide.
