Patna High Court

Pappu SadaversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted bail to the petitioner with specified monetary and attendance conditions.

Summary

Pappu Sada was arrested in connection with the recovery of 117 litres of illicit liquor and charged under Sections 30(a) and 41 of the Bihar Prohibition and Excise Act. He had been in custody since 3 April 2026 and claimed innocence, asserting that he has no prior criminal record and is willing to donate Rs. 25,000 to a charitable organization. The State opposed his bail application. The High Court, after considering the facts and the petitioner's submissions, ordered his release on bail upon furnishing a Rs. 10,000 bond with two sureties, depositing Rs. 25,000 with Ramakrishna Math, and complying with attendance conditions at the police station. The Court also directed verification of the petitioner's antecedent before accepting the bail bonds. The bail was granted subject to these conditions.

Issues considered

  • Whether bail should be granted to a person accused under Sections 30(a) and 41 of the Bihar Prohibition and Excise Act for possession of illicit liquor
  • Whether the petitioner's claim of innocence, clean antecedent, and willingness to make a charitable donation justify bail
