Patna High Court

Gautam KumarversusThe State of Bihar

Decided
Disposal
BAIL REJECTED

Holding

Anticipatory bail was refused as the petitioner’s ownership of the seized motorcycle established sufficient connection to the offence.

Summary

The petitioner, Gautam Kumar, was the registered owner of a motorcycle from which 75 litres of illicit liquor were seized, leading to a case under Section 30(a) of the Bihar Prohibition and Excise Act. He applied for anticipatory bail, arguing that no incriminating material was found in his personal possession and that he had a clean antecedent. The State opposed the bail, contending that ownership of the vehicle linked him to the offence. The court considered the ownership of the seized vehicle as sufficient nexus to the alleged crime. It held that the petitioner’s claim of lack of direct possession did not merit anticipatory bail. Consequently, the court refused the anticipatory bail application.

Issues considered

  • What is the appropriate legal standard for granting anticipatory bail when the accused is the registered owner of a vehicle from which contraband is seized?
