Sachin KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court allowed the bail application, granting regular bail with conditions.

Summary

The petitioner, Sachin Kumar, was arrested in connection with a case under Section 30(a) of the Bihar Prohibition and Excise Act for allegedly possessing 237.6 litres of illicit liquor recovered from two motorcycles. He filed an application for regular bail, claiming innocence and offering to donate Rs. 25,000 to a charitable organization without admitting guilt. The State opposed the bail, but the court considered the facts, the period of custody since 17 April 2026, and the submissions of both parties. The court allowed the bail, directing the petitioner to furnish a bail bond of Rs. 10,000 with two sureties and to deposit Rs. 25,000 with the Ramakrishna Mission Sevashrama, producing a receipt. Additional conditions were imposed, including attendance at the police station on specified Sundays, and the court clarified that its observations were prima facie and not a determination on the merits of the case.
