Champa DeviversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted bail to the petitioner, directing release on bond with sureties subject to Section 482(2) conditions.

Summary

The petitioner, Champa Devi, was arrested in connection with the recovery of 80 litres of illicit liquor under Section 30(a) of the Bihar Prohibition and Excise Act, 2022. She claimed a clean antecedent and offered to donate Rs. 25,000 to charity without admitting guilt. The State opposed her bail application. The High Court, after considering the facts, the period of custody, and the submissions, allowed the bail application. The court directed her release on bail upon furnishing a Rs. 10,000 bond with two sureties of the same amount, subject to conditions under Section 482(2) of the Criminal Procedure Code. The court clarified that its observations were prima facie and not a determination on the merits of the case.

Issues considered

  • Whether bail should be granted to the accused under Section 30(a) of the Bihar Prohibition and Excise Act, 2022.
  • Whether the conditions prescribed under Section 482(2) of the Criminal Procedure Code are applicable.
