Patna High Court

Fantesh KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioner subject to the conditions of Section 438(2) CrPC and Section 482(2) BNSS, 2023.

Summary

Fantesh Kumar was named in an FIR for alleged cyber fraud and related offences under the Bhartiya Nagrik Suraksha Sanhita and the Information Technology Act. The petitioner argued that his name was recorded only based on statements of co‑accused and that no incriminating material was recovered from his possession, citing that similarly situated co‑accused had already been granted bail. The State opposed the bail application. The Court observed that the allegation against the petitioner was prima facie based on suspicion and, in the absence of seized material, found no justification to deny bail. Accordingly, the Court directed that the petitioner be released on bail upon furnishing a bond of Rs 10,000 with two sureties, subject to conditions under Section 438(2) of the CrPC and Section 482(2) of the BNSS, 2023.

Issues considered

  • Whether bail should be granted when the petitioner’s involvement is alleged only on the basis of co‑accused statements and no material has been seized from him
  • Whether the petitioner is entitled to parity with co‑accused who have already been released on bail
