Patna High Court

Devanand RavidasversusThe State of Bihar

Decided
Disposal
DISMISSED

Holding

Regular bail was not granted to the petitioner.

Summary

The petitioner, Devanand Ravidas, was charged under Sections 191(2), 191(3), 190 and 103(1) of the Bharatiya Nyaya Sanhita, 2023 for allegedly assaulting a victim who later died, as supported by a post‑mortem report. The investigation named him as one of the assailants, and he has been in custody since 18‑04‑2026 with a prior criminal antecedent. He applied for regular bail, arguing that he should be released pending trial. The Court examined the seriousness of the offence, the evidential material and the petitioner’s antecedent, and concluded that the nature and gravity of the crime did not warrant regular bail. Consequently, the bail application was dismissed, with a direction that the petitioner may seek bail again if the trial is delayed. The judgment emphasizes that its observations are prima facie and do not prejudice the merits of the trial.

Issues considered

  • Whether the petitioner is entitled to regular bail despite the seriousness of the offence and his criminal antecedent
  • Whether the evidence, including the post‑mortem report, justifies denial of bail under the Bharatiya Nyaya Sanhita, 2023

                                2. The petitioner seeks regular bail in connection with

Beur P.S. Case No. 212 of 2026 registered for the offence under

custody since 18.04.2026 and has one criminal antecedent.

                                    5. Considering the nature and the gravity of the

                      petitioner.

                                    6. Accordingly, this application for regular bail stands

                      prayer for bail.

adjudication of the present bail application. Such observations

shall not be construed as an expression on the merits of the case
