Patna High Court

Ashutosh Singh @ LalaversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioner subject to verification of the compromise between the parties.

Summary

The petitioner, Ashutosh Singh, was arrested in connection with a dowry‑related case (Mahila P.S. Case No. 21 of 2026) alleging offences under several sections of the Bihar Negotiable Act and the Dowry Prohibition Act. The prosecution alleged that the petitioner and others demanded dowry and, upon non‑payment, assaulted the informant. The petitioner contended that he is the husband of the informant, was falsely implicated, and that the matter has been settled between the parties. The High Court, after hearing counsel, noted the alleged compromise and, subject to verification of that compromise, granted bail. The court ordered release on a bail bond of Rs. 10,000 with two sureties, conditional upon the informant’s support of the compromise.

Issues considered

  • Whether bail should be granted to the petitioner despite the serious nature of the dowry‑related offences
  • Whether a compromise between the parties can justify bail in a case involving offences under the Bihar Negotiable Act and the Dowry Prohibition Act
