BAIL GRANTED

Holding

The Court granted bail to the petitioner subject to a bond of Rs.10,000 and two sureties, conditional upon arrest or surrender within eight weeks and compliance with Section 482(2) of the BNSS 2023.

Summary

Surudhi Kumari petitioned for bail after being implicated in a case under Sections 30(a), 30(c), 41(1) and 45 of the Bihar Prohibition and Excise Act and Section 27 of the Arms Act, following the seizure of 600 kg of Jawa Mahua and 20 litres of country-made liquor. She asserted that no incriminating material was found in her possession, she had a clean antecedent, and that the allegations were based solely on suspicion. The State opposed the bail. The Court, after considering the facts and circumstances, ordered that if the petitioner is arrested or surrenders within eight weeks, she may be released on bail upon furnishing a bond of Rs.10,000 with two sureties of the same amount, subject to the conditions of Section 482(2) of the BNSS 2023. The bail order was directed to be complied with by the District & Additional Session Judge‑V, Special Judge Excise‑I, Biharsharif. The petition was thereby disposed.
