The court granted anticipatory bail to the petitioner under Section 438(2) of the CrPC.

Summary

The petitioner, Praveen Kumar, applied for anticipatory bail fearing arrest in a case (Kudhani P.S. Case No. 111 of 2021) involving alleged offences under Sections 341, 342, 406, 420, 467, 468, 506 and 34 of the IPC. The prosecution alleged that the petitioner, along with others, abducted the husband of the informant, kept him captive, and forced a sale deed of land. The petitioner contended he was neither buyer nor seller, that the allegations were vague, and that he had no criminal antecedent. The State opposed bail. After hearing both sides, the court, applying Section 438(2) of the CrPC, ordered the petitioner to surrender within four weeks and granted anticipatory bail upon furnishing a bail bond of Rs.10,000 with two sureties, subject to standard conditions. The bail application was therefore allowed.

Issues considered

  • Whether anticipatory bail can be granted to the petitioner under Section 438 of the CrPC in view of the alleged offences.
  • Whether the petitioner is likely to tamper with evidence, influence witnesses, or abscond if released on bail.
