Patna High Court

Umesh SinghversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted regular bail to the petitioner subject to a bail bond, sureties, a monetary donation, and attendance conditions.

Summary

Umesh Singh was arrested in connection with the seizure of 87 litres of illicit Nepali liquor from a motorcycle, alleged to be a violation of Sections 30(a) and 30(d) of the Bihar Prohibition & Excise Act, 2016. The petitioner, who has two prior criminal records, had been in custody since 25 April 2026 and sought regular bail, offering to donate Rs.25,000 to a charitable organization without admitting guilt. The State opposed the bail application. The High Court, after considering the facts and submissions, allowed the bail application, directing the petitioner to furnish a bail bond of Rs.10,000 with two sureties of the same amount, deposit Rs.25,000 with the Ramakrishna Mission Ashrama, and attend the Phenhara Police Station on the first and third Sundays of each month. Failure to comply with these conditions would result in cancellation of bail. The order was pronounced by Justice Sandeep Kumar.

Issues considered

  • Whether bail should be granted in a case involving alleged offences under Sections 30(a) and 30(d) of the Bihar Prohibition & Excise Act, 2016.
  • Whether the petitioner’s prior criminal antecedents preclude the grant of regular bail.
  • Whether the conditions imposed (monetary donation, bail bond, sureties, and periodic police station attendance) are lawful and appropriate.
