Patna High Court

Rabindra SinghversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted bail to the petitioner subject to a bond and sureties.

Summary

The petitioner, Rabindra Singh, was arrested in a case under sections 80(2), 103(1) and 3(5) of the Bharatiya Nyaya Sanhita, 2023, relating to alleged dowry harassment and the death of his daughter‑in‑law. He contends that the deceased committed suicide and that no specific overt act has been alleged against him, asserting that the allegations are general and aimed at the husband of the deceased. The State opposed his bail application. The Court examined the material and, noting the lack of specific incriminating facts, ordered that the petitioner be released on bail upon furnishing a bond of Rs.10,000 with two sureties, subject to the conditions of Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023. The order also stipulated that the bail be granted if the petitioner surrenders within eight weeks.

Issues considered

  • What is the adequacy of the material against the petitioner to justify denial of bail?
  • Whether the petitioner is entitled to bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 despite the serious nature of the allegations.
