Patna High Court

Md. AhadversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioner on the condition of a bond and compliance with stipulated conditions.

Summary

The petitioner, Md Ahad, was arrested on 11 April 2026 as the driver of a pickup van from which 447.84 litres of Indian-made foreign liquor was recovered. He was charged under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022. The petitioner argued that he had no knowledge of the illicit liquor, was not the vehicle's owner, and that the investigation failed to comply with Sections 103 and 105 of the Bihar Narcotic/Excise (BNSS) Act, 2023. The State opposed bail, but the court noted the petitioner’s clean antecedent and the procedural lapses. Consequently, the court granted bail on a Rs.10,000 bond with two sureties, subject to conditions of cooperation, presence in court, and non‑tampering with evidence or witnesses.

Issues considered

  • Whether bail should be granted to the driver accused under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022 given the facts of recovery and alleged procedural non‑compliance.
  • Whether the alleged non‑compliance of Sections 103 and 105 of the BNSS, 2023, warrants bail.
