The Court granted bail to the petitioner subject to a bond and specific conditions.
Summary
The petitioner, Ranjit Kumar, was arrested on 3 January 2024 in connection with a murder case (IPC Sections 302/34 and Arms Act Section 27) arising from FIR No. 495 of 2021, where the FIR initially named the offender as unknown. During investigation, the petitioner’s name was disclosed through the confessional statement of a co‑accused, Golu @ Rohit Kumar, leading to a chargesheet and framing of charges on 24 April 2026. The petitioner sought bail, arguing that he was not originally named in the FIR and that co‑accused persons had already been released on bail. The State opposed bail, noting that the petitioner has four other pending cases, though he is on bail in three of them. The Court, after considering the circumstances, granted bail on a bond of Rs.10,000 with two sureties and imposed conditions regarding trial attendance, non‑tampering with evidence, and verification of criminal antecedents.
Issues considered
- What is the appropriateness of granting bail to the petitioner when his involvement is based solely on a co‑accused’s confession?
- Do the petitioner’s other pending criminal cases affect the grant of bail in the present murder case?
