Patna High Court

Koshila DeviversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted anticipatory bail, holding that the recovery of illicit liquor did not constitute conscious possession by the petitioner.

Summary

The petitioner, Koshila Devi, was named in an FIR for alleged illegal manufacture and trade of illicit liquor, with 16 liters recovered from the back side of her house. She contended that the liquor was found in an open area accessible to the public and not under her conscious possession, emphasizing her clean antecedent. The Additional Public Prosecutor opposed her request for anticipatory bail. The court examined the factual submissions and noted that the recovery did not appear to be from her conscious possession. Consequently, the court ordered that she be released on bail, subject to a bond of Rs.10,000 with two sureties and conditions under Section 438(2) of the CrPC and Section 482(2) of the BNSS. The bail is to be surrendered within four weeks if arrested.
