Patna High Court

Pankaj ManjhiversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioner subject to specified conditions.

Summary

Pankaj Manjhi was arrested on 20 April 2026 in connection with a case under Section 30(a) of the Bihar Prohibition and Excise Act, involving the alleged recovery of 75 litres of country‑made liquor. The petitioner argued that he had a clean antecedent, that the liquor was seized behind the house of a co‑accused and not from his conscious possession, and that the investigation failed to comply with Sections 103 and 105 of the BNSS, 2023. The State opposed bail. The Court, noting the lack of possession, the procedural lapses and the petitioner's clean record, granted bail on a bond of Rs.10,000 with two sureties, subject to conditions of cooperation, appearance, and non‑tampering with evidence. The bail order also directed verification of the petitioner's criminal antecedents. The bail was ordered without delay for verification.

Issues considered

  • Whether bail should be granted when the accused is not found in conscious possession of the seized liquor.
  • Whether non‑compliance with Sections 103 and 105 of the BNSS, 2023 warrants bail.
  • Whether suspicion alone suffices to keep the accused in custody.
