Patna High Court

Sunil KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Anticipatory bail was granted as the recovery of illicit liquor was not made from the petitioner's conscious possession and he has a clean antecedent.

Summary

The petitioner, Sunil Kumar, was not named in the FIR but was implicated in an alleged illegal liquor trade involving the recovery of 70 litres of illicit liquor from a scooty under Section 30(a) of the Bihar Prohibition and Excise Act. He contended that the seized liquor was not in his physical possession and that the seizure list lacked independent witnesses, emphasizing his clean antecedent. The Additional Public Prosecutor opposed his anticipatory bail. The court observed that the recovery did not appear to be from the petitioner's conscious possession and, considering his clean record, directed that he be released on anticipatory bail upon furnishing a bail bond of Rs.10,000 with two sureties, subject to conditions under Section 438(2) of the CrPC and Section 482(2) of the BNSS. The order was pronounced by Justice Chandra Shekhar Jha.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under Section 438 CrPC given the alleged involvement in illegal liquor trade.
  • Whether the recovery of illicit liquor can be attributed to the petitioner in the absence of direct possession and independent witnesses.

petitioner that recovery of alleged illicit liquor was not made

from physical possession of this petitioner, who is a man of

          doubtful.
