Patna High Court

Shambhu Bhagat @ Shambhu PrasadversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioner subject to specified conditions.

Summary

Shambhu Bhagat was arrested on 17 February 2026 in connection with an FIR dated 29 January 2026 alleging theft of electricity that led to the death of an informant's husband and threats to the informant. The prosecution charged him under Sections 105 and 3(5) of the BNS, 2023 and Sections 135 and 138 of the Electricity Act. The petitioner contended that he has a clean antecedent, the FIR was filed three days after the alleged incident without explanation, and that he was falsely implicated due to a prior dispute, with no FIR from the electricity department. The Additional Public Prosecutor opposed bail. The High Court, after considering the facts, granted bail on a bond of Rs.10,000 with two sureties, imposing conditions of cooperation, presence in court, non‑tampering with evidence, and verification of antecedents. The bail order was made subject to cancellation if conditions are breached.

Issues considered

  • Whether bail should be granted to the petitioner pending trial for offences under the BNS, 2023 and the Electricity Act.
  • Whether the delay in filing the FIR and alleged false allegations affect the grant of bail.
  • Whether the petitioner’s clean antecedent and risk of tampering with evidence justify bail.
