Patna High Court

Dheeraj Kumar JhaversusThe State of Bihar

Decided

BAIL GRANTED

Holding

The court granted bail to the petitioner, directing release on a bond of Rs. 10,000 with two sureties, subject to Section 482(2) conditions.

Summary

The petitioner, Dheeraj Kumar Jha, was named in an FIR for assaulting an informant and his co‑accused under several sections of the Bihar Negotiable Statutes (BNS). The informant alleged that the assault was in retaliation for a viral video concerning his second wife, and the victim was allegedly released after paying a ransom. The petitioner sought bail, arguing that a co‑accused had already been granted bail and that the injuries were simple, while asserting his clean antecedents. The State opposed bail, contending the allegations were serious. The court observed that the allegations were prima facie general and the injuries were minor, and, applying the principle of judicial parity, directed that the petitioner be released on bail with a bond of Rs. 10,000 and two sureties, subject to conditions under Section 482(2) of the BNS. The bail order was issued pending further trial in the lower court.

Issues considered

  • Whether the petitioner is entitled to bail despite the serious nature of the charges under Sections 127(2), 115(2), 118(1), 352, 351(2) and 3(5) of the BNS.
  • Whether the grant of bail to a co‑accused creates a right to bail for the petitioner on the basis of judicial parity.
  • Whether the nature and extent of the alleged injuries justify the grant of bail.
