Patna High Court

Ankit Kumar SharmaversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted bail to the petitioner subject to a bond and specific conditions.

Summary

Ankit Kumar Sharma was arrested in connection with a violent incident arising from a land dispute, where the informant was assaulted and a firearm was used. The prosecution charged him under multiple sections of the Bihar Negotiable Substances Act, 2023 and Section 27 of the Arms Act. Sharma contended that he was not named in the FIR and was falsely implicated, arguing that the allegations of assault were directed at other co‑accused. The State opposed bail, citing Sharma’s four prior criminal cases, though he was on bail in those matters. The High Court, after considering the circumstances and the petitioner’s claim of false implication, granted bail on a bond of Rs. 10,000 with two sureties and imposed conditions regarding trial cooperation, evidence tampering, and verification of antecedents.

Issues considered

  • Whether bail should be granted to the petitioner despite the seriousness of the offences and alleged criminal antecedents
