Patna High Court

Md. ManirversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted bail to the petitioner subject to bond and surety conditions.

Summary

The petitioner, Sunni Kumar, was arrested in connection with a 2023 case alleging that he captured and circulated obscene photographs of a female informant and threatened her, invoking Sections 354 and 506 of the IPC and Section 66A of the IT Act. The petitioner contended that the alleged incident occurred in 2019, no photographs were seized, and he cooperated fully with the investigation, which culminated in a charge‑sheet. He applied for bail, asserting a clean antecedent and that arrest was unnecessary. The Additional Public Prosecutor opposed bail. The High Court, noting the completed investigation, the charge‑sheet, and the petitioner’s clean record, ordered his release on bail subject to a bond of Rs.10,000 and two sureties, and conditions under CrPC Section 438(2) and BNSS Section 482(2).

Issues considered

  • Whether the petitioner is entitled to bail despite charges under Sections 354, 506 IPC and 66A IT Act
  • Whether the petitioner’s cooperation and clean antecedent justify release without arrest
