Holding
The court granted anticipatory bail to the petitioner, subject to conditions, recognizing the lack of direct evidence and procedural lapses.
Summary
The petitioner, Farman Raza, was implicated in a case under Section 30(a) of the Bihar Prohibition and Excise Act for the seizure of 190.380 litres of illicit foreign liquor. He claimed innocence, arguing that the only evidence against him was a confession by a co-accused and that no liquor was found in his possession, also noting non‑compliance with Sections 103 and 105 of the BNSS. The State opposed anticipatory bail, invoking Section 76(2) of the same Act and citing the petitioner’s three prior criminal antecedents. Relying on the Full Bench decision in Ram Vinay Yadav v. State of Bihar (2019 PLJR 1089), the court considered the lack of direct evidence and procedural lapses. The court granted anticipatory bail under Section 438(2) of the CrPC, subject to a bail bond, sureties, and several conditions including cooperation with the trial and no tampering with evidence.
Issues considered
- Whether anticipatory bail should be granted to the petitioner under Section 438 CrPC in a case of alleged illicit liquor possession where evidence is limited to a co‑accused confession.
- Whether the non‑compliance of Sections 103/105 of the BNSS and the petitioner’s prior criminal antecedents preclude grant of anticipatory bail.
